These Terms and Conditions govern the relationship between "Aleteia" EOOD on the one hand and Customer on the other hand, for the use of webinar/online training registration services, referred to for short as the "Service", made through the site https://www.e-psiholog.eu/, referred to as the "Site" for short, operated and administered by "Aleteia" EOOD.

Please read these Terms and Conditions in full before using the site and the services offered on it.

These General Terms and Conditions contain information about the activities of "Aleteia" EOOD and the general conditions for using the services provided by "Aleteia" EOOD, by regulating the relations between "Aleteia" EOOD  и Customer.

The confirmation of the General Terms and Conditions is a necessary and mandatory condition for the conclusion of the contract between "Aleteia" EOOD и Customer.

With the acceptance of the General Terms and Conditions and on the basis of conclusions between Customer и "Aleteia" EOOD contract, The customer agrees to have his personal data processed.  

With the fact of accessing the site and using it The user and / or The customer agrees to abide by these General Terms of Use.

The user and / or The customer agrees not to reproduce, distribute, sell, resell or use for any commercial purposes the content of the site.

Art. 2. Data for "Aleteia" EOOD.

"Aleteia" EOOD is a sole proprietorship limited liability company, registered under the Commercial Law of the Republic of Bulgaria, entered in the Commercial Register, with EIC 203247004, VAT registration No. BG203247004, address: Sofia, Hubcha St. No. 8, floor 1, office A1, email address: office@psihika.eu

Art. 3. Conclusion of contracts and entry into force.

These General Terms and Conditions are binding on "Aleteia" EOOD – on the one hand and for The customers - from another. The General Terms and Conditions are effective and binding on Customer from the time of receipt by "Aleteia" EOOD e-mail confirmation of service registration. The obligations of "Aleteia" EOOD arise from the moment of receipt of full payment for the registration for the service in accordance with the conditions specified in the advertisement for the service. When the registration for a service is made on behalf of a legal entity or on behalf of another entity within the meaning of the current Bulgarian legislation, then the party to the contract is the legal entity, respectively the other entity. For cases in which registration for a service is made by a legal entity or a natural person, or another entity for the benefit of another person or other persons, the party to the contract with "Aleteia" EOOD  are all adults who will use the service, and the person who registered for the service is jointly and severally liable for the obligations of Customer.

Upon registration for a service, these General Terms and Conditions constitute a contract for the provision of a service concluded remotely (online) between "Aleteia" EOOD  и Customer. The contract between "Aleteia" EOOD и Customer is considered concluded upon confirmation of registration by "Aleteia" EOOD and payment instructions. By registering for a service, The customer confirms and accepts the present General Terms and Conditions for registration and the terms agreed in them for holding a webinar/online training and payment, program, conditions for canceling registrations for services, etc. These terms are binding "Aleteia" EOOD to provide the stated by Customer attendance at the specific webinar/online training according to the name data provided by him through the registration form Customer or to the persons named by him, date of event and after performed and received by "Aleteia" EOOD payment. Primary duty of Customer is to pay the fee for his participation in amounts and terms as indicated by "Aleteia" EOOD in the specific ad. The location of the webinar/online training on Customer will be provided only in the presence of prepayment agreed in the service announcement. In the absence of prepayment for the service organized by "Aleteia" EOOD, it "Aleteia" EOOD  is not responsible for the performance of the service.  

Art. 4. Basic definitions.

Within the framework of these General Terms and Conditions, the concepts listed below should be understood as follows:

Site - this includes https://www.e-psiholog.eu and all its subpages, including the forum: https://www.e-psiholog.eu/forum/

Announcement – that is any statement made by "Aleteia" EOOD online and/or offline, indicating the date of the webinar/online training, their program, presenters and price.

Register – represents data provision actions from Customer in the registration form electronically or otherwise, including by email and telephone, pursuant to which "Aleteia" EOOD и The customer conclude a contract at a distance.

User – a person who interacts with the site.

Customer - this is a natural person, legal entity or other legal entity within the meaning of the current Bulgarian legislation, which after prior payment acquires the right to use the services provided by "Aleteia" EOOD and/or has personally or through a third party registered for a webinar/online training, through an announcement and after fully familiarizing himself with the General Terms and Policies of "Aleteia" EOOD. The customer is a party to the contract with "Aleteia" EOOD.   

Personal data – this is any information that identifies or can be used to identify, contact or locate the person to whom this information relates. More about personal data and how they are protected by "Aleteia" EOOD should be read in Security Policy on "Aleteia" EOOD.

Service – all activity carried out by "Aleteia" EOOD behind Customer, which provides registration for and attendance at a webinar/online training organized by "Aleteia" EOOD, for which there is a pre-announced date for holding a webinar/online training, program, host/s and price.

Terms of service – these are these Terms and Conditions, which include terms of use, cookie and privacy policies, service registration rules, voluntary dispute resolution, contract cancellation and replacement and complaint forms and any other legally relevant information found on the site.

"Force majeure" and "Force majeure" - these are such phenomena, acts, actions or inactions of third parties, including technical failures and others, which prevent "Aleteia" EOOD to perform the registered service.

Service contract – a contract under which "Aleteia" EOOD provides or undertakes to provide a service to Customer, The customer pays or undertakes to pay in advance the price for the service specified in the service advertisement.

Alternative consumer dispute resolution procedure – a procedure for out-of-court resolution of consumer disputes, which meets the requirements of current Bulgarian legislation and is carried out by an authority for alternative resolution of consumer disputes. 

Art. 5. Technical steps for registering for a service.

The customer should fill in certain data in the electronic registration form or provide this data in another way to "Aleteia" EOOD, to register for a service.

The data required to register for a service for an individual are: name and surname of Customer, correctly spelled by Customer valid real email, contact phone number.

The data required to register for a service for a legal entity are: company name, EIC, correctly written by Customer valid real e-mail address, management address, position and name and surname of the employee who will attend the event, and if there are several employees who will attend - their names and surnames.

All collected personal data, which is entered in the registration form, is used solely and only in accordance with the detailed description on the site here: Security Policy on "Aleteia" EOOD.

Registration for the service is considered complete after written confirmation by electronic means (email) from "Aleteia" EOOD, that the registration for the service is successful.

Art. 6. Technical steps to confirm service registration.

Immediately after registering for a service, but no later than 48 hours after its execution, The customer will receive from email at "Aleteia" EOOD to the correct email indicated by him, confirmation of the registration for the service. This confirmation email will contain the basic data for the selected service, as well as an instruction for prepayment, accompanied by a proforma invoice, as well as a statement of, or reference to these General Terms and Conditions.

The terms of service (date, price, payment, cancellation and change conditions, program, host/s) are binding on Customer from the moment of its confirmation by "Aleteia" EOOD, but for "Aleteia" EOOD - from the moment of prepayment of the entire fee for the event according to the specific conditions. The services offered by "Aleteia" EOOD, should be fully prepaid to ensure their performance. Please read on for more information Art. 3 from the General Terms and Conditions.

The place to participate in Customer for the selected service, it will be reserved for 7 working days from the sending of the proforma invoice, in which period the fee for the service should also be paid. In case of non-payment of the service fee within this period, the place to participate in the selected service will be released in favor of other applicants Customers. The right of participation of Customer in the selected service occurs upon full payment of the fee for it in advance.

Art. 7. Service Fees and Payment Method.

The fees for the services arranged by "Aleteia" EOOD, are in Bulgarian leva and include all taxes.

The fee for each specific service is specified in the advertisement for that service. The fee should be paid by Customer in Bulgarian leva at the latest within 7 days of receiving the proforma invoice. The payment is considered to have been made from the receipt of the amount for the fee in the bank account of "Aleteia" EOOD. The non-payment of the service by Customer in term can be counted from "Aleteia" EOOD for cancellation of service by Customer. At the discretion of "Aleteia" EOOD in which case the service registration may be deleted or unilaterally canceled by "Aleteia" EOOD. Unpaid services do not give rise to obligations for "Aleteia" EOOD

The fee for the selected from Customer service is paid once in Bulgarian leva at the latest within 7 days of receipt of proforma invoice. The method of payment for the service is indicated in the advertisement itself and also in the email confirming the registration for the service.

The advertised service charge includes only the presence of one Customer in a webinar/online training, but not additional costs such as the Internet needed by the Client and others.

"Aleteia" EOOD receives payment for services only and exclusively by bank transfer via bank transfer in Bulgarian leva to the following bank account:

In favor of the:  "Aleteia" EOOD

"Aleteia" EOOD issued to indicated by Customer person invoice for the service after receipt of full prepayment for service to the bank account indicated above "Aleteia" EOOD. In case of periodic prepayments for services, an invoice is issued for each prepayment separately.

"Aleteia" EOOD reserves the right to change the fees of the services offered on the site at any time and without notice, such changes will not affect already completed service registrations.

Art. 8. Promotions - reductions, discounts and package prices.

"Aleteia" EOOD reserves the right to announce promotional prices. Promotional offers are valid only under the relevant conditions specified in the advertisement and cannot be a reason for a request by Customer to reduce the price for other services other than those in the advertisement for the service held on a specific date for which the promotion or grounds for complaint apply.

Art. 9. Service Registration Cancellation Policy. Refusal to participate in a webinar/online training.

Item 1) Cancellation of service registrations by the Customer.

The customer should carefully check the conditions of registration for the selected service before requesting participation in a webinar/online training. Unless otherwise indicated during registration for the service, it may be refused (cancelled) free of charge and without penalty by Customer and without the need for the Customer to indicate a reason for refusal (cancellation), within 14 days from the date of the email confirming the registration for the service from "Aleteia" EOOD.

Cancellation should be made by unambiguous notification to "Aleteia" EOOD by any of the following ways: sending a completed refusal (cancellation) form to "Aleteia" EOOD, including by e-mail or in another appropriate and convenient way for the customer, for example notification of "Aleteia" EOOD on the phone. The refusal (cancellation) request should contain data about Customer and details of the service being cancelled, including but not limited to: Customer names, date and name of webinar/online training being cancelled, and others. The customer will be informed upon successful cancellation of service registration.  

Paid by Customer the service fee is refunded within 14 days of the refusal as indicated by Customer bank account, if the refusal is made within the established 14-day period from the receipt of the notice of refusal (cancellation). In case of cancellation after this period,  "Aleteia" EOOD withholds the fee paid in full, and may at will offer to Customer participation in another webinar / online training. If a replacement is refused, "Aleteia" EOOD does not owe a fee refund.

Point 2) Cancellation of registration for a service by "Aleteia" EOOD.

"Aleteia" EOOD may unilaterally and without owing compensation and penalties, cancel a service registration of Customer or to cancel a webinar/online training in the following cases:

  1. Full or partial non-payment of a webinar/online training fee by the Client under the terms and conditions agreed in the advertisement.

In this case, a refund of the service fee paid by the Client (if applicable) is due only if the cancellation of the registration for the service is within the terms providing for the return of paid sums (see Article 9, point 1);  

  1. Occurrence of force majeure circumstances and/or force majeure events preventing Aleteia EOOD from performing the requested services within the specified time and place for reasons beyond Aleteia EOOD's control (technical problems of any nature, prohibition or other act issued by the competent state authorities, natural disasters and accidents preventing the conduct, epidemic situation, impossibility of the presenter to conduct the webinar/online training and others).

In such cases as described above "Aleteia" EOOD will offer to Customer service of the same quality and fee or a higher fee and quality without additional payment from Customer, for other dates, and in case of refusal of replacement by Customerthen "Aleteia" EOOD has the right without the consent of Customer and without being responsible for this, to cancel the registration for the service, in which case it will refund 100% of the paid value for the webinar/online training within 14 days of the cancellation of the registration for the service.

  1. Insufficient number of participants for webinar/online training.

When there is a lack of the required number of participants to hold a webinar/online training specified in the advertisement, "Aleteia" EOOD can cancel the event by postponing it to another date or offer to Customer participation in another webinar/online training. In case of refusal of change or replacement by Customerthen "Aleteia" EOOD will refund 100% of the value paid for the registry service within 14 days of cancellation. 

  1. In cases where "Aleteia" EOOD cancels registration for a service due to reasons for which "Aleteia" EOOD is solely responsible, that "Aleteia" EOOD offers to Customer similar service under the same or better conditions without additional payment by Customer. In case of refusal of replacement by Customerthen "Aleteia" EOOD within 14 days of the refusal to exchange, refunds 100% of the value paid for the service, such as the fees (penalties and compensations) payable by "Aleteia" EOOD, are identical to the applicable benefits which The customer would pay if The customer cancel the registration for the service at that time, but not more than the paid value for the event.
  1. In cases where "Aleteia" EOOD unilaterally terminates the contract due to violation of these General Terms and Conditions by the Client, as well as in violation of the legislation in force in the Republic of Bulgaria and in violation of generally accepted moral and ethical norms, thereby canceling registration for the service, Article 14 of these General Terms and Conditions applies.
  1. In the cases described in detail in Art. 7. of these General Terms and Conditions.

For canceled service registration The customer may be informed by e-mail or by other means, including by telephone.

Art. 10. Changes to Terms of Service.

Changes to the date, program, host/s, fees, payment terms and service cancellation policy are permitted only under the conditions set out below:

  1. Change of webinar/online training date.

Change of webinar/online training dates by "Aleteia" EOOD is allowed only in the event of force majeure and/or force majeure events preventing "Aleteia" EOOD to perform the requested services in the specified time and place for reasons independent of "Aleteia" EOOD and others, detailed in Art. 9, point 2), subsection 2.

  1. Changing the number of participating Clients in a webinar/online training:

 

2.1. Changing the number of participating Clients in a webinar/online training by the Client.

Changing the number of participants Customers in a webinar/online training by   Customer in the direction of increase is permissible only and only after confirmation by "Aleteia" EOOD, that the service can be performed according to the additional number of participants in the webinar/online training and after agreeing on the terms and the amount of the additional payment. Changing the number of participants Customers in a webinar/online training by Customer in the direction of reducing the number of participants, is permissible without incurring fees and penalties for this, if the change in the number is during the 14 day period of free cancellation from Customer, but no later than 5 days before the event. After this period "Aleteia" EOOD does not owe refunds for participants who cannot attend the event.  

2.2. Change in the number of participating Clients in a webinar/online training by "Aleteia" EOOD.

"Aleteia" EOOD reserves the right to change the number of participants in a webinar/online training in the direction of increasing the number of participants, in which case no other conditions regarding the provided service will be changed, for which it does not owe notification to The customers, who have already paid a fee for the service.

  1. Change of Customers.

Within 10 days before the date of the event The customer is entitled without payment of fees and penalties by giving notice to "Aleteia" EOOD by e-mail to state a desire to change the names of the participants in the webinar/online training, if the number of participants does not change. In this case, a party to the service contract with "Aleteia" EOOD is/are the new entrants, the Transferor and the Transferee are jointly and severally liable for payment of the Service Fee. Changes to the participants after the specified period are considered accepted by "Aleteia" EOOD, only upon express confirmation by "Aleteia" EOOD. In the absence of confirmation, the change is not accepted, as in case of non-appearance Customer Article 7 applies.  

  1. Change of the venue for the webinar/online training, the program and presenter(s).  

In cases where circumstances arise which lead to "Aleteia" EOOD can unilaterally change the program, the presenter(s) and the venue for the webinar/online training with others, under the same conditions, up to 10 days before the date of the webinar/online training The customer agree that this change is minor. "Aleteia" EOOD sends notification to Customer by email about the change, within 3 days of receiving the email  The customer informs "Aleteia" EOOD for your decision. In the absence of a written objection from Customer, it is assumed that  The customer has accepted the change. When negotiating between Customer и "Aleteia" EOOD to accept another replacement service provided by "Aleteia" EOOD, which has a lower fee, it The customer is entitled to a refund of the price difference. If the service is canceled after the change,  The customer receives 100% of the amount paid by him to the bank account specified by him.

  1. Change of fee for webinar/online training.

The final fee for attending a webinar/online training is not subject to change unless there is an express and unequivocal agreement between "Aleteia" EOOD и Customer, formed only in writing, including by e-mail. 

Art. 11. Failure to appear on the day of the webinar/online training.

If  Customer, whose fee has been paid, does not join online on the day of the webinar/online training, will be considered a no-show. In the absence of Customer, paid by Customer fees are not refundable, as "Aleteia" EOOD reserves the right to claim the difference between the part paid and the full value of the fee if a partial payment of a service fee has been made.

Art. 12. Access to webinars/online training. 

Organized by "Aleteia" EOOD webinars/online trainings always have the exact date and start time indicated. "Aleteia" EOOD send within 3 days before the date of the webinar/online training to the specified by Customer email, instructions for accessing the webinar/online training in the form of a link, such as The customer undertakes not to provide this information to third parties. The paid fees for attending a webinar/online training give the right to attend only to those persons for whom "Aleteia" EOOD is notified in advance that they will be present.

Art. 13. Complaints and Problem Reporting.

In the event of a problem arising in connection with a webinar/online training, a report and/or complaint can be submitted by phone: 0886 677 325, e-mail: office@psihika.eu or to inform "Aleteia" EOOD  in another unambiguous manner convenient to the customer. In case of a problem or complaint, The customer should notify "Aleteia" EOOD without undue delay and no later than 24 hours after learning, taking into account the specific circumstances of the case. Notification must be made in writing or in another form convenient for the customer, including by e-mail or any other technical means that makes it possible to reproduce it. 

The customer has the right within 24 months of paying for the service to make a complaint, send messages, requests or complaints about the quality of the service provided in writing or verbally by phone, e-mail or in any other appropriate way convenient for the customer.

When making a claim The customer indicates the subject of the complaint, his preferred way of satisfying the complaint, names, address, phone and email contact.

When submitting a complaint The customer must also attach the documents on which the claim is based, namely:

– invoice or bank statement for payment made;

– evidence establishing the non-compliance of the service with the agreed upon;

- other documents establishing the claim by basis and amount.

Notification of a complaint is in writing, and notification by e-mail and other methods convenient to the customer are also permissible.

If desired by the client and for his convenience, the following optional form can be used:

"Aleteia" EOOD maintains a Register of submitted claims. On Customer a document is sent to the e-mail specified by him, in which the claim number from the Register and the name of the service are indicated.  

Complaints are considered no later than 30 days from their receipt, and in the event that the complaint is justified, The customer is entitled to compensation:

– Replacement of the service with another similar or more expensive and better quality service without additional payment of the difference in the fee when choosing a more expensive service;

– Deduction from the price;

– Refund of 100% of the paid from Customer an amount proven by an invoice and/or a bank statement for the payment made;

When "Aleteia" EOOD satisfies the claim, issues a certificate to that effect, which is drawn up in two copies and obligatorily provides one copy to Customer.

 Art. 14. Intellectual Property and Copyright.

  1. All materials, resources on the site, as well as all those related to the services (webinars/online trainings) of "Aleteia" EOOD, including the available databases, benefit from the protection of the current Copyright Law and its related rights, as well as the international agreements to which Bulgaria is a party.
  2. The republishing of materials published on the site, e-magazine "Psychia", webinars, online trainings (or parts of them) is possible only after agreement with their authors or with "Aleteia" EOOD. In this case, it is mandatory to indicate a specific author and that the material is provided by the site and place an active hyperlink (https://e-psiholog.eu).
  3. No part of the materials described in item 1 can be used for commercial purposes.
  4. The copyright of the materials, as well as their related rights (translation, compilation, processing rights, etc.) belong to the persons who created them (according to Art. 5, 9, 11, 12 of the Law on copyright and its related rights ).
  5. CC0 Creative Commons (free for commercial use with no attribution required) and unrestricted license photos are used, as well as own design digital works that are copyrighted by "Aleteia" EOOD. Paid and licensed PowerPoint and Publisher templates and resources are used. In case of problems, please contact immediately "Aleteia" EOOD on convenient channels for you!
  6. Access to published materials, resources and others by "Aleteia" EOOD can be stopped only at the initiative of "Aleteia" EOOD upon receiving irrefutable evidence of plagiarism, harming third parties, etc. offenses which were not known to "Aleteia" EOOD at the time of their publication.
  7. None of the "Aleteia" EOOD is not responsible for the actions of third parties, as well as for damages incurred, unrealized profit, etc.
  8. "Aleteia" EOOD has the right to claim compensation for direct and indirect damages suffered in full in cases where intellectual property related to the site, e-magazine "Psychia" and provided by "Aleteia" EOOD services.

Art. 15. Termination and cancellation of the contract.

"Aleteia" EOOD reserves the right at its sole discretion without notice to Customer, to unilaterally terminate the contract, in cases where he finds that the services provided by "Aleteia" EOOD services are used by Customer in violation of these General Terms and Conditions, as well as in violation of the current legislation in the Republic of Bulgaria and in violation of generally accepted moral and ethical norms.  

The contract between the parties is also terminated when the activity of "Aleteia" EOOD or ceasing to maintain the site on "Aleteia" EOOD.

Apart from the cases mentioned above, each of the parties may cancel this contract in case of non-fulfillment of the obligations under the contract, by giving a ten-day written notice to the other party. Sending by e-mail is also considered a valid form of notification. Reimbursement of paid fees is in accordance with Art. 9 of these General Terms and Conditions.

Art. 16. Disputes and Jurisdiction.

All disputes regarding the service contract entered into between Customer и "Aleteia" EOOD, will be resolved by the parties by mutual agreement. If the parties do not reach an agreement, the dispute will be referred to the competent court, according to the legislation of the Republic of Bulgaria, with the parties determining Bulgarian laws as the applicable law.  

Everyone Customer, who is a party to the contract with "Aleteia" EOOD, may initiate proceedings for alternative resolution of consumer disputes under the Consumer Protection Act before the General Conciliation Commission of the Commission for Consumer Protection, with headquarters: Sofia, Slaveykov Square No. 4A, phone: 02/ 9330 517, website www.kzp.bg, e-mail: adr.sofia@kzp.bg. The procedure is voluntary and out of court, and the decision of the body for alternative dispute resolution is not binding on the parties to the dispute. Disputes between the parties may also be referred to the European Commission's consumer dispute resolution platform, available at: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.adr.show .

Art. 17. Personal Data.

"Aleteia" EOOD makes every effort to comply with the current legislation in the field of personal data protection, ensuring a reliable and secure site, protection of the provided data against accidental or intentional manipulation, loss, destruction and access by unauthorized persons. "Aleteia" EOOD regularly reviews its security systems and processes. Sensitive information such as bank details and others are protected by encryption protocols to protect information sent over the Internet. Art. 18. Correspondence and Communication.

Upon completion of service registration, The customer agrees to receive an email containing information about the registration made. To ensure the use of the service, The customer must use a real and valid, correctly spelled email address. "Aleteia" EOOD (including employees of "Aleteia" EOOD) is not responsible and has no obligation to check wrongly or incorrectly presented data when registering for services, including email addresses, phone numbers and others.

"Aleteia" EOOD and all Customers (individuals, legal entities, other entities), as well as visitors to the site, agree that the following are accepted for contact between the parties:

Art. 19. Amendment of the General Terms and Conditions.

These General Terms and Conditions may be changed unilaterally by "Aleteia" EOOD at any time by updating them on the site managed and administered by "Aleteia" EOOD and subject to the provisions of the Consumer Protection Act (CPLA) and the Commercial Code (TC), whereby the change takes effect immediately.

"Aleteia" EOOD undertakes to notify The customers for any amendment to these General Terms and Conditions within 7 days of the occurrence of this circumstance on the date indicated by Customer e-mail address.  

In the event that the Customer does not agree with the amendments to the general conditions, the latter within 1 month from the notification by written notification to "Aleteia" EOOD may withdraw from the contract and cancel its registration without giving a reason and without paying compensation or penalty, or continue to perform it under the General Terms and Conditions in force before the amendment. If The customer does not exercise its right to withdraw from the contract in accordance with the procedure set out in these General Terms and Conditions within the 1-month period of written notification, the amendment is considered to have been accepted by Customer no objections.

The General Terms and Conditions enter into force immediately for all Customers, without the need for notification, in the event that the changes made to the General Terms and Conditions are imposed by virtue of an effective legal act.

Art. 23. Additional provisions.

"Aleteia" EOOD и The customer declare that in the event that any of the clauses under these General Terms and Conditions is/are found to be invalid, this will not result in the invalidity of the entire contract or any of its other parts. The invalid clause will be replaced by the mandatory norms of the law or established practice.
